Data protection information in accordance with the EU General Data Protection Regulation ("GDPR").

With the following information, we provide you with an overview of how we process your personal data and your rights under data protection laws and regulations in connection with the use of our apps and websites for reserving and renting parking spaces ("ampido").

In doing so, ampido complies with all data protection laws and regulations. These include, in particular, the German Telemedia Act (TMG), the German Federal Data Protection Act (BDSG), the data protection provisions of the German Telecommunications Act (§§ 85 et seq. TKG) and the legislative requirements at EU level.

2. Processing purposes and data categories

In the following, we would like to inform you about which personal data we process and for which purposes we do so.

2.1 What data is collected?

To register with ampido, a valid e-mail address and a password are required as minimum information. In order to use the paid functions, the user must also provide payment information, a mobile phone number and the license plate number of the vehicle with which the parking transaction is to take place. All information provided by the user will be treated confidentially. They are transmitted and stored and used only for the execution and administration of the contract.

When you make a parking reservation with ampido, we transmit to the lessor of the parking space your license plate number, the start and end date of the reservation and the time at which the reservation took place. In particular, this is so that the lessor can determine whether there is a car with a valid booking in his parking space.

Our users also have the possibility to provide additional voluntary information about themselves. Here they can determine themselves in the settings of their ampido account which information they wish to disclose and to what extent.

By using the ampido website or the ampido applications, information about the use of the website and the applications is automatically transmitted to ampido, including personal data as well as the functions used, search queries, date and time, the IP address and the operating system of the end device used by the respective user, the version number of the ampido application used as well as the type and version number of the Internet browser used by the user to use the ampido website.

2.2 For what purposes is the data processed?

The collection, storage, processing and use of the aforementioned data is carried out by ampido in accordance with the legal provisions.

Collection, storage, processing and use of the data serve to provide our users with the products and services of the ampido marketplace via the ampido website as well as the ampido applications, and to process customer support requests.

Furthermore, the data is used to bill the use of the parking spaces offered and rented by ampido.

When registering for ampido's newsletter, the e-mail address provided by the user will be used by ampido for its own advertising purposes until the user unsubscribes from the newsletter. Unsubscribing is possible at any time. For this purpose, an e-mail to support@ampido.com or an informal letter to ampido GmbH, Bismarckstraße 19, 50672 Cologne, Germany, shall suffice.

In order to continuously improve the offer and the technical functionality of ampido and to better meet the needs of its users, ampido analyzes the behavior of its users in the network. For this purpose, anonymized user profiles are created. When evaluating these profiles, the identity of the user remains unknown. ampido guarantees under technical, personnel and organizational aspects that the anonymized user profiles cannot be merged with the personal data of the users.

3. Processing service providers and processing in countries outside the European Economic Area

In some cases, we use external service providers to process your data (e.g. troubleshooting, customer service, creation of mailings). For this purpose, it is necessary that we transfer your personal data to our external service providers for a specific purpose (limited to the respective purpose). Our service providers have been carefully selected by us and commissioned in writing. They are bound by our instructions and we have informed ourselves about their technical and organizational measures for the security of the processing of personal data. Furthermore, we require our service providers to comply with the applicable data protection regulations. We work with service providers from the EU and the USA. For this purpose, we have concluded order processing contracts with our external service providers pursuant to Article 28(3) DS-GVO or EU standard contractual clauses pursuant to Article 28(7) DS-GVO. The transfer to service providers outside of the European Economic Area takes place accordingly on the basis of decisions of the EU Commission pursuant to Article 45 of the GDPR (e.g. Privacy Shield).

We store all our data with a cloud service provider within the EU or in IT infrastructures and devices (employees' computers) at our locations within the EU.

Furthermore, we work with payment service providers who enable payment processing for us.

We do not sell personal data to third parties.

However, we reserve the right to disclose information about you if we are required to do so by law or if we are requested to do so by public authorities or law enforcement bodies (e.g. police or public prosecutors).

4. Cookies, web analysis services and social media
4.1 Cookies

Current web browsers provide a cookie database. There, the web server of a visited website can store information in the form of HTTP cookies and read them when the page is visited again. By placing cookies, only anonymous user IDs are assigned to users. Under no circumstances are programs executed on the user's computer or even computer viruses transmitted.

ampido uses persistent cookies to authenticate the user when logging in. This makes it easier for the user to log in to ampido. The use of cookies thus serves solely to ensure the smooth operation and improvement of ampido's offers.

In addition, each user has the free choice through settings in his web browser to accept cookies, to be informed when a cookie is placed or to generally reject all cookies. However, it is not possible to use ampido's services if cookies are generally rejected.

4.2 Server Log Files

Each time the user visits the ampido website, the user's web browser transmits access data that is automatically stored by ampido in log files, the so-called server log files. These log files contain the following information:

IP address, by which the computer can be identified

Remote host (name and IP address of the computer requesting the page)

Time, status, geo information, amount of data transferred and the internet page from which the user came to the requested page (referrer)

Product and version information of the browser used (user agent)

ampido uses the standardized "combined" log file format of the Apache web server for this purpose.

The log files are analyzed for statistical purposes, e.g. to detect broken links. The log files are then deleted.

As a matter of principle, this data is not merged with other data sources, in particular with personal user data. However, ampido reserves the right to check still stored log files for the last known IP address of a user in the event of a specific legal or contractual violation. This is primarily for the protection of ampido members and the security of ampido member data.

4.3 Google Maps

The ampido platform (apps and website) uses the Google Maps API application. This allows us to show you maps in the ampido platform and also allows you to use the maps. Without the Google Maps API application, our ampido platform cannot function. You can view Google's terms of use here: https://policies.google.com/terms?hl=de. After you have consented via your respective operating system, we use Google Maps to interactively show you the distance of the parking lot to your searched destination. In doing so, we process your GPS location data in accordance with Article 6 (1) b) DS-GVO. We only pass on your GPS location data to Google in anonymized form. The identification of your person is excluded.

4.4 Google Analytics & Google Adwords

4.4.1 Google Analytics

This website uses the analysis service Google Analytics. This web analysis service is operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter referred to as Google).

This analysis tool works on the basis of cookies. A cookie is a text file that is sent when you visit a website and is temporarily stored on the hard drive of the user of the website to enable an analysis of your use of the website. The information stored by the cookie is usually transferred to a Google server in the USA and then stored there.

Within the scope of IP anonymization, your IP address will be shortened beforehand by Google within a member state of the EU or another state party to the Agreement on the European Economic Area. On our behalf, Google will use the transmitted information to create a report about the use of the website. The IP address transmitted as part of Google Analytics will not be merged with other data from Google. If you wish to prevent the use of cookies, you can do so by locally making changes to your settings in the Internet browser used on your computer (e.g. Safari, Internet Explorer, Opera, Firefox, etc.), i.e. the program used to open and display Internet pages. Furthermore, you can prevent the collection and processing of your data by Google's cookie by downloading and installing a browser plugin offered by Google at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

4.4.2

ampido also uses the online advertising program "Google AdWords" and conversion tracking as part of Google AdWords. The cookie for conversion tracking is set when a user clicks on an ad placed by Google. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the website of the AdWords customer, in this case ampido GmbH, and the cookie has not yet expired, Google and the AdWords customer can recognize that the user clicked on the ad and was redirected to this page. Each customer receives a different cookie, i.e. cookies can thus not be tracked across the websites of AdWords customers. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. The customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users. A connection between your personal data and your usage data is therefore not possible. If you wish to disable conversion tracking cookies, you can set your browser to block cookies from the following domain: "googleadservices.com". 4.5. Facebook plugins (Like button)

Plugins of the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA are integrated on our pages. You can recognize the Facebook plugins by the Facebook logo or the "Like button" ("Like") on our page. You can find an overview of the Facebook plugins here: http://developers.facebook.com/docs/plugins/

When you visit our pages, a direct connection between your browser and the Facebook server is established via the plugin. Facebook thereby receives the information that you have visited our site with your IP address. If you click the Facebook "Like" button while logged into your Facebook account, you can link the content of our pages on your Facebook profile. This allows Facebook to associate the visit to our pages with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Facebook. 4.6. Google +1

Collection and sharing of information:

Using the Google +1 button, you can publish information worldwide. via the Google +1 button, you and other users receive personalized content from Google and our partners. Google stores both the information that you have given +1 for a content and information about the page you were viewing when you clicked +1. Your +1s may be displayed as notices along with your profile name and photo in Google services, such as search results or your Google profile, or elsewhere on websites and ads on the Internet.

Google records information about your +1 activities in order to improve Google services for you and others. To use the Google +1 button, you need a globally visible, public Google profile, which must contain at least the name chosen for the profile. This name is used in all Google services. In some cases, this name may also replace another name you used when sharing content through your Google Account. The identity of your Google profile may be displayed to users who know your email address or have other identifying information about you.

Use of Collected Information:

In addition to the uses explained above, the information you provide will be used in accordance with applicable Google privacy policies. Google may publish aggregate statistics about users' +1 activities or share them with users and partners, such as publishers, advertisers or affiliated websites.

4.7. Twitter

Functions of the Twitter service are integrated on our pages. These functions are offered by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA. By using Twitter and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and made known to other users. In the process, data is also transferred to Twitter.

We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Twitter. For more information, please refer to the privacy policy of Twitter at: http://twitter.com/privacy.

4.8. Mailings and newsletters

Emails and newsletters for existing customer communication are sent using MailChimp, a newsletter delivery platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in the context of these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and display of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to address them itself or to pass them on to third parties. We trust in the reliability and IT as well as data security of MailChimp.

4.9. Customer service

To process customer inquiries, ampido uses Planio, a customer service platform of

Planio GmbH, Rudolfstr. 14, 10245 Berlin, Germany. Planio's servers are located in the EU. Planio is bound by the Privacy Shield Framework and all associated data protection regulations and is certified accordingly. According to Planio, it takes care to maintain high security standards.

5. Your rights

You have the right to request information from us at any time about the personal data we have stored about you, as well as about its origin, recipients or categories of recipients to whom this data is disclosed or passed on, the purpose of storage and processing, the planned storage period and the automated decision-making processes carried out by us. Furthermore, the right to data portability, about the existence of a right to rectification, erasure, restriction of processing or an objection to processing and about any existing right of complaint to a supervisory authority. In addition, you have the right to correct incorrect data and, if the legal requirements are met, to block and delete as well as to restrict the processing of data. 6. Data security

ampido makes regular backups of its data, which are overwritten at regular intervals (approx. 4 weeks) and thus permanently deleted. In case of a complete deletion of a user profile, backups of the user profile are also deleted. ampido uses constantly updated firewalls and other security systems. These are intended to protect users as best as possible from viruses and unauthorized access to ampido from outside.

ampido makes every effort to maintain an appropriate level of protection. The applied security technologies are constantly adapted to the current state of technical development. Nevertheless, a hundred percent protection against attacks cannot be guaranteed. ampido is not responsible for virus protection outside the network. For damage and destruction of data by unknown viruses ampido is also not responsible.

7. Storage period

In principle, we process and store your data for the duration of our contractual relationship. In addition, we are subject to various storage and documentation obligations. The periods specified there, e.g. from tax law, can be up to 10 years. Furthermore, special legal regulations may make a longer retention period necessary, e.g. evidence in connection with statutory limitation periods. If data are no longer necessary for the fulfillment of contractual or legal obligations, they are regularly deleted, unless their limited further processing is necessary for the fulfillment of the purposes listed above.

8. Enforcement and Compliance with this Privacy Statement

ampido undertakes to comply with the standard set out in this data protection declaration and to constantly work on improving data protection in the interests of its users.

9. Changes to the data protection declaration

Since ampido's offer is subject to constant changes, it may be necessary to make changes to the data protection declaration and the data protection information in individual cases. The same applies to changes in the relevant legal regulations, which may require an adjustment.
